Mum of six sues Bauer Media over graphic Woman’s Day sex post on Facebook
A MOTHER of six is suing Bauer Media after her photo was allegedly used to illustrate a graphic sex post on Woman’s Day’s Facebook page.

FRESH from winning reductions to its defamation payout to Rebel Wilson, Bauer Media is being sued by a Melbourne mother of six over a graphic sex post.
The woman, who the Herald Sun has chosen to identify as “Jane”, claims last month Woman’s Day published a post on its Facebook page which in part read: “‘Rushing to the hospital, I wondered how my date had gone so wrong’.
“Lisa thought she had a sexy night ahead of her when her Tinder date agreed to come over for drinks …”

The post then details an injury Lisa suffered having sex.
A photo of Jane in a hospital gown lying on a hospital bed accompanied the post.
According to Jane’s County Court writ, her photo was taken to promote Operation Thailand, a TV show that featured her as one of three women undergoing cosmetic surgery in Thailand and Bauer Media never sought her permission, or informed her of its intention, to use the photograph with the unrelated post.
Since Jane’s husband discovered the posts, she says she has suffered depression and anxiety. She is seeking unspecified aggravated damages for defamation.
The Woman’s Day post also contained a link to Bauer Media’s Take 5 website entitled “Sex sent me to the ER!” with the subheading “Lisa, 42, shares her true life story”.
That story includes further graphic details of Lisa’s encounter with Tinder date Barry and being rushed to hospital with a ruptured bowel.
Jane claims she has been approached by family members, friends and colleagues who recognised her on the Woman’s Day Facebook page or read the Take 5 story.
Jane alleges the articles defamed her by suggesting she was promiscuous; unfaithful to her husband; of loose sexual morality; and though married, had engaged in a “one night stand” and was in the habit of dating people through dating app Tinder.
The writ claims the posts also suggest she consented to intimate details of her private life being published on social media and was happy to advertise her infidelity and promiscuity on the internet.
Jane alleges Bauer Media refused to publish an apology for using her photo in circumstances that were “improper and unjustifiable”.
Jane claims her credit and reputation have been badly injured, and she is entitled to aggravated damages for the loss and damage she has suffered.
Bauer Media failed to respond to the Herald Sun.
