A TEEN who fathered a baby by repeatedly raping his 14-year-old sister is hoping to avoid jail over the shocking case which has torn his family apart.

A TEEN who fathered a baby by repeatedly raping his sister, 14, is hoping to avoid jail.

The teen raped his sister three times over a year, despite her pleading with him to leave her alone and that she feared falling pregnant.

Just over a year after the first rape, her worst nightmare was realised: doctors found she was 31 weeks pregnant.

Her brother was arrested at school the next day, after the girl informed her parents.

He has had no contact with his family since.

The boy, now 17, who pleaded guilty to rape and incest on Monday, blames a lack of sex education in his native Africa.

The court heard he hadn’t grown up with his sister, first meeting her when he was 12.

“It (a normal sibling relationship) is not the relationship he’s ever really had with her,” the boy’s lawyer said.

“He was an unhappy, angry, isolated person, missing his family in (Africa).” But she said he wasn’t “someone without insight or empathy”.

A psychologist’s report found the boy’s crimes “should be viewed more in the context of experimentation than offending”, the court heard.

But a magistrate rejected the submission, describing the result of the boy’s crimes as “a significant and lifelong consequence for a 14-year-old”.

Lawyers for the boy called for a non-custodial sentence.

But police argued the “gravity of the offending is probably almost more significant than any other offence”.

The magistrate indicated that a jail term was justified, but said she had yet to determine the ultimate sentence.

She said there were positive signs regarding the boy’s rehabilitation: he was engaging well with counsellors, was attending school, and had shown genuine remorse.

The boy, who is on bail, will be subject to further assessments before being sentenced later this year.
