A Gold Coast man has been jailed for beating his friend senseless amid revelations the assaulted man had apparently slept with his ex-girlfriend.
Jarod Adam Boynton, 38, appeared via audiovisual link in Southport District Court on Tuesday, where he pleaded guilty to a charge of grievous bodily harm.
The attack occurred on September 27, 2021 at Nerang.
Boynton met his victim during a prior jail stint and they became friends. At the time of the offence, Boynton was using the man’s residence as his bail address.
On the afternoon in question, Boynton’s friend was drinking with his 80-year-old housemate when Boynton came over to collect some clothes.
As the trio conversed, Boynton’s friend admitted he had slept with the defendant’s on-off girlfriend (they were apparently ‘off’ at the time, although this was a matter of some conjecture at the sentencing hearing).
Boynton “flew into a rage”, in the words of both Crown prosecutor Genevieve Feely and defence counsel Harold Rafter, and punched his friend up to 54 times, according to the elderly housemate.
Throughout the assault, Boynton’s friend was repeatedly knocked to the ground, striking his head. He kept apologising throughout the assault.
The elderly housemate eventually called emergency services, who arrived to find Boynton’s friend “semiconscious [and with his] clothes soaked in blood,” Ms Feely said.
Boynton’s friend sustained injuries including a missing tooth, a fractured nose, a cut lip, an acute subdural haematoma, and a vertebral artery dissection.
He subsequently suffered a brain aneurysm and an acute embolic posterior stroke, although it could not be determined sufficiently they were directly attributable to Boynton’s actions.
He has since made a full, or near enough to full, recovery.
The court heard Boynton had two prior matters of violence on his criminal history, neither of which resulted in convictions but both of which occurred while he was heavily intoxicated.
He had spent 221 days in pre-sentence custody, dating back to September.
Mr Rafter told the court his client grew up near Kingaroy and had an unremarkable upbringing, although he had struggled with alcohol and drugs since his late twenties.
He said his client had a good work history featuring multiple different industries. He had work waiting for him upon his release from custody.
Justice Deborah Holliday KC sentenced him to three years’ imprisonment with court-ordered parole release on November 16 this year, by which point he would have effectively served 14 months.
On Wednesday, Boynton was also sentenced in the Southport Magistrates Court for dozens of summary charges he pleaded guilty to, including drug, property and weapons offences.
He received a variety of concurrent prison terms ranging from two to three months, none of which affected his overall head sentence for the charge of grievous bodily harm.
