A man has fronted court to face a charge of trespass after he was captured on camera stealing a quick 40 winks in his underpants in a private fishing boat.
Dylan Gordon Jackson pleaded guilty in the Ingham Magistrates Court on Thursday to unlawfully entering a private property in the coastal town of Lucinda on March 8.
Prosecutor Ash Raj said the property owner was alerted by a CCTV warning on his phone that a stranger had entered his yard and clambered into his boat in a carport at 11.45pm.
“The following morning, police spoke with the victim and viewed the CCTV footage … the defendant was observed wearing only his underpants and speaking on a mobile phone, he has then climbed into the boat where he laid down for several minutes,” he said.
“He then appeared to wake up then rummage through tackle boxes and storage containers in the vessel – he then climbed out and walked off down the street.”
In a twist in the bizarre case, Mr Raj said that the victim worked at a nearby pub and had previously served the defendant alcohol.
Magistrate Cathy McLennan sought further clarification.
“So he’s drunk, he’s wearing his underpants, only his underpants, and it’s midnight?”
“Yes, Your Honour, those are the facts,” Mr Raj replied.
Defence lawyer Jessika Hockings said her client, a seasonal commercial fisherman, was intoxicated and “it was a stupid, drunken decision”.
“By entering the early guilty plea he does demonstrate remorse.”
Jackson was released on a good-behaviour bond of $300 for six months.
No conviction was recorded.
