THE CFMEU will face the Federal Court over claims it delayed works and attempted to strongarm a company working at Geelong Grammar in 2014.
Fair Work Building and Construction will allege CFMEU Geelong organiser Brendan Murphy entered the school grounds on December 3 and closed down the site because subcontractors were not covered by an enterprise agreement with the union.
Mr Murphy told the Geelong Advertiser he would defend the claims and said he remembered there was asbestos through the site.
“The job was held up over Occ Health and Safety,” he said.
In the statement of claim, FWBC said Murphy was repeatedly asked by the site manager to present his right of entry permit but refused.
FWBC director Nigel Hadgkiss said right-of-entry provisions were designed for permit holders to access sites for genuine business.
