A few words spoken over the divider between nightclub booths allegedly sparked a brutal brawl at a CBD watering hole that left a man with nerve damage and a partially paralysed face.

Maribyrnong man Marty Albert, 45, who police allege is a patched member of the Bandidos Outlaw Motorcycle Club started the brawl, according to court documents.

He was last month convicted over the incident and fined $1000 at the Geelong Magistrates Court.

Albert, who police said held the rank of sergeant-at-arms of the club’s Melbourne chapter, pleaded guilty to assault, affray, possessing ice and failing to appear at court.

His co-accused, Toby Elvey and Matthew Rizzo, have not yet entered pleas and are due to face a committal hearing next month, where a magistrate will decide if the matter should be sent upstairs to the County Court.

Documents recently released by the court after Albert’s conviction shed new light on the incident, which took place on October 22 last year.

According to the police summary, on October 21 a group of about 20 Bandidos bikies were in Geelong “potentially to socialise with each other”.

Later that night, Albert was sitting in a booth at Manhattan bar with Mr Elvey and their partners at 12.30am, police allege, while Mr Rizzo, was at the bar nearby.

Both Mr Elvey and Mr Rizzo are also patched members of the Bandidos, according to police.

The alleged victims, two men aged 38 and 42, were in a nearby booth, and were not known to the three suspected bikies and had never interacted with them before.

According to the documents, the altercation began when one of the alleged victims looked over the divider separating the booths and “interacted with the accused’s table”.

The summary does not specify what was said, but it allegedly prompted Albert to get up, walk over to the victim’s booth, push one man out of the way and punch the other three times.

During the brawl, Albert and one of the victims ended up grappling on the floor.

The man suffered a sore temple, jaw and tail bone, as well as a bite mark on his cheek.

Meanwhile, Mr Rizzo and Mr Elvey allegedly assaulted the other victim, who was swung around by the hoodie and knocked unconscious when his head struck either the chair or the floor, according to court documents.

He was punched and kicked in the head by Mr Rizzo and Mr Elvey while unconscious, court documents allege.

The beating resulted in a broken nose, multiple facial fractures, a “protracted concussion”, cuts to the back of his head, “constant dizzy and fatigue spells” and nerve damage causing partial facial paralysis.

According to the documents, police viewing the CCTV immediately recognised Albert and his co-accused from an earlier interaction, when they came across a car parked in a no standing zone about an hour before the brawl.
