A small businessman responded to kids egging his house on Halloween by stalking them in the street with his two teen sons, eventually catching up with one and causing her leg to be broken, a court has heard.
Logan Village man Daniel Shedrawi, 46, formerly of Burleigh Waters, appeared in Southport Magistrates Court on Thursday where he pleaded guilty to charges of going armed so as to cause fear and driving without due care and attention causing grievous bodily harm.
An earlier charge of dangerous operation of a motor vehicle causing grievous bodily harm was discontinued by the prosecution.
The offending occurred on Christine Ave, Burleigh Waters, on the night of October 31, 2023.
Shedrawi’s house was egged by a group of youths and he responded by clambering into his Toyota Avalon alongside his two teenage sons, who were wearing balaclavas and armed respectively with a baseball bat and a metal pole, the court heard.
His sons are not charged with any criminal offences.
The court was told Shedrawi and his sons eventually caught up with the victim, who was riding pillion on an electric bike driven by a friend. The defendant pulled his vehicle close – way too close – to the e-bike as it was being ridden on the road.
The victim child, a 15-year-old girl, kicked out at his vehicle, and in doing so suffered an undisplaced fracture to her left tibia.
The police prosecutor told the court it was not alleged Shedrawi purposely struck the child or personally anticipated the child would kick out at his car, but rather that his driving exceedingly close to the e-bike materially contributed to the harm caused.
Defence counsel Martin Longhurst told the court his client, a truck driver who had recently purchased his own Fox Mowing franchise, was “very embarrassed” by the incident.
He told the court the teenagers who had egged his client’s house on the night in question had done so multiple times, and Shedrawi had dutifully reported it to the police on each occasion, but no action had been taken.
“He was frustrated with the cops not taking it seriously,” Mr Longhurst said.
“[The Halloween egging] was the straw that broke the camel’s back.”
Mr Longhurst said it had been Shedrawi’s intention, in driving so close to the e-bike, to allow one of his son’s to film the fleeing pair, in order to provide police with evidence of their identity.
“He’s not to know she’s injured herself [after kicking his vehicle], they don’t even fall off the bike,” Mr Longhurst added.
Magistrate Nerida Wilson told Shedrawi his actions were totally out of proportion to the provocation, labelling them “threatening, intimidating, bullying”.
She asked him to imagine it was one of his own children who had been “hunted down by a deranged male... [in a] vigilante-style action, going through the streets with baseball bats”.
Shedrawi was fined $1500, disqualified from driving for six months, and ordered to pay his victim $1000.
No convictions were recorded.
