A PORMPURAAW man has made a bid for bail after being charged with punching his partner to the ground and then throwing boiling water over her.

The Cairns Magistrates Court on Monday also heard that because 47-year-old Winston Tyore’s partner had been medivacced to Cairns with burns to approximately 12% of her body and would likely be transported to Brisbane, he wished to apply for bail to remain in the Cape York community.

Mr Tyore was charged with two counts of common assault and one count of acts intended to cause grievous bodily harm over the April 29 incident.

Defence lawyer Karen Longhurst said her client had indicated pleas of guilty to the three charges and if granted bail would reside with his brother and would agree to conditions not to go near the aggrieved nor drink alcohol.

Police prosecutor Senior Constable James Chapman said Mr Tyore was in a show cause position and had been referred to Queensland Police Services’ high risk domestic violence team.

Snr Const Chapman submitted there was a risk to Mr Tyore’s partner if she returned to Pormpuraaw and he was not incarcerated.

The court heard Mr Tyore and his partner had been drinking and gambling with family members when they walked to his uncle’s place in Pormpuraaw where they continued drinking.

In refusing Mr Tyore’s bail, Magistrate Terence Brown described how an argument broke out and Mr Tyore was angry because his cup wasn’t being filled with wine.

“The defendant pushed a child away with the broomstick and he was told to stop. The defendant then punched the victim to the left side of her face. He punched with such force that she fell to the ground,” Mr Browne said.

“She has gone to the ground at that time and the defendant has removed the rice cooker bowl from the stove and thrown the boiling water at the victim.”

Mr Browne said the alleged incident was a very serious example of domestic violence and that the victim was at significant risk of further acts of domestic violence being perpetrated towards her.

“In the circumstances the court is not persuaded there are any conditions that could be imposed to reduce that to an acceptable level,” he said.

A brief of evidence for the charge of acts intended to cause grievous bodily harm was directed to be disclosed to the defence by June 13 and Mr Browne remanded Mr Tyore in custody, with his matters next to be mentioned on June 15.
