A serial stalker held a knife to the mother of children’s throat, in front of their kids, before he called her 114 times from prison threatening to kill her.

A serial stalker held a knife to the mother of children’s throat, in front of their kids, before he called her 114 times from prison threatening to kill her.

Timothy Charles Kennedy, 36, pleaded guilty to one charge of stalking after he conducted a “serious persistent” period of threats and abuse against his ex which continued with death threats after he had been imprisoned.

He sat in court crying as the judge read out his crimes.

Crown prosecutor Emily Thambyah told the court, over a five month period, Kennedy consistently threatened, stalked and abused his ex-partner, the mother of his children.

Ms Thambyah said despite his imprisonment Kennedy continued his abuse and threats from prison.

She said Kennedy’s conduct included significant threats to not only his ex-partner but also her mother, including threats to set her on fire.

Judge Joshua Trevino KC said aside from the threats to kill the messages which included video messages were “extremely derogatory and demeaning”.

Ms Thambyah told the court about previous acts of domestic violence Kennedy had perpetrated against the complainant including breaking into her and their childrens’ home by breaking a window before grabbing a knife and pretending to cut himself in front of the woman and his children.

“The second occurred in similar circumstances the following night, the defendant returns to the house, jumps the fence and refuses to leave before forcing a door open,” Ms Thambyah said.

“He has again grabbed a knife and cut his wrist in front of the kids.

“The complainant has walked away and he has put the knife around her neck and pulled her to the ground, all in front of the children.

“One of the children has picked up the knife, he has taken back the knife and continued cutting his wrists.”

Ms Thambyah said Kennedy’s disregard of police and the court was clear.

“Kennedy told her the ‘police will never stop me’,” she said.

“He continued, when he was remanded, with a continuation of similar conduct, threats and comments to harm her and her new partner.

“He said she was ‘his property’.”

Defence counsel John Seccull told the court Kennedy was “emotionally unregulated” and “very unwell at the time” with a drug addiction.

Judge Trevino said Kennedy called the woman 114 times from prison.

“In many of those calls, all of which were recorded, you called her derogatory names, threatened to harm her and told her she would always be yours,” he said.

“You showed no desire to stop your offending of your own accord and displayed no remorse or insight into your behaviour while in prison.

“People in your situation should not be able to make a mockery of the criminal justice system.”

Judge Trevino sentenced Kennedy to three years and one month imprisonment with a parole eligibility date of June 19, 2025 having already served 279 days in custody.
