ACCC issues Federal Court proceedings against Gary Bourne and Megasave Couriers

The ACCC has launched Federal Court action against NSW man Gary Philip Bourne and courier business after seeking an order to obtain details of his offshore payments, including to this woman.

The Australian Competition and Consumer Commission has filed “substantive proceedings” in the Federal Court against a national courier business and its NSW owner.

The ACCC confirmed to The Daily Telegraph it had taken legal action against Megasave Couriers Australia and Gary Phillip Bourne, who is also known as Gary Peter Matthew Maison Bourne.

The ACCC’s move was foreshadowed last month when it sought freezing orders over Megasave and Mr Bourne’s assets.

The proposed freezing orders, a copy of which was obtained from the court by The Telegraph, say Mr Bourne and Megasave “must not remove from Australia or in any way dispose of, encumber, or otherwise deal with or diminish the value of any of … assets whether held in Australia or overseas.”

The ACCC wanted the proposed orders applied to four bank accounts — one in the name of Megasave, another for a company called Ozwide Couriers and two in Mr Bourne’s name.

The proposed order also sought to force the 57-year-old Gosford man to detail his worldwide assets, as well as all payments Megasave had made to him and him to it since April last year, including anything going into or out of an account in Hong Kong.

And the orders would have compelled him to disclose any payments made by him or Megasave since that date to Mariz Bourne, who appears to live in Lipa in the Philippines.

A lawyer for Mr Bourne and Megasave told The Telegraph “the orders sought in the original application were set aside”.

“There are no freezing orders in place at the moment and the ACCC has not filed any substantive proceedings as yet.

“Our clients presently have nothing to respond to,” the lawyer said.

However, in the orders sought by the ACCC it gave the court an undertaking it would “issue substantive proceedings” within 14 days.

On Friday, the ACCC told The Telegraph it had done as it had said it would.

What is alleged is unknown.

It’s understood Mr Bourne has given a formal undertaking with the same effect as the freezing orders the ACCC had sought.

His lawyer wouldn’t comment when asked about this.

Megasave, which was only registered as a company in 2018, describes itself as “the newest and fastest genuine courier franchise opportunity currently available in Australia.”

On his LinkedIn page, Mr Bourne says Megasave “plans to be fully national by the end of 2021.

“Australia doesn’t need another Fastway, Australia needs another Australia Post,” he wrote.
