A Melbourne man who took an intimate photo of a teenager in bondage had his matter finalised in court.
Bruno Timpano, now 40, pleaded not guilty regarding an intimate photo of a teenager found on his phone.
Police accused Timpano of knowingly possessing child abuse material at Caroline Springs in March 2021.
One image described in court depicted the teen bent over naked in bondage restraints.
However, he was found not guilty at Sunshine Magistrates’ Court on August 3.
Mr Timpano’s defence said the matter went beyond the content of the image itself and the context was vital.
Magistrate Kay Robertson found in all circumstances the reasonable person would not find it offensive.
The court heard that Mr Timpano forgot he had the image before he was charged.
Magistrate Robertson made an order for the photo to be deleted.
Mr Timpano will seek costs of $20,000.
The prosecution applied for a three month stay.
