A man accused of assaulting hospital guards with a chair and scratching a police officer in a fight over treatment for a heart complaint has fronted court.

Toby Thirlway is also alleged to have punched his mother into a garden bed and has been accused of launching a threatening campaign against a mate who he had fallen out with.

The Doveton 24-year-old faced Dandenong Magistrates’ Court on Thursday on charges of assault, using a carriage service to harass, criminal damage and court order breaches.

Mr Thirlway, who was on a community corrections order at the time of the alleged offending, is yet to formally enter a plea and his case was adjourned for legal discussions over a sentence indication.

The court heard he attended the emergency department of Monash Medical Centre in Clayton in February with an elevated heart rate.

While waiting to be treated he allegedly became aggressive and a security alarm was called.

When hospital guards arrived on scene Mr Thirlway allegedly picked up a chair and swung it at them, hitting one on their arm and another in their face.

Police then arrived and as he was being held down he scratched the arm of one officer, causing a 20cm cut, before he was sedated by doctors.

In January this year Mr Thirlway attended a Noble Park motel where his mother was staying.

He is accused of forcing open her front door, knocking over furniture, breaking a TV and punching his mother to her face, causing her to fall into a garden bed.

And he is also alleged to have harassed and threatened a former pal via phone and text messages on dozens of separate occasions.

In screenshots saved by the man Mr Thirlway allegedly repeatedly called him a paedophile and said he would take down “the f***ing dog c***”.

Defence lawyer Adam Maloney said his client, who had a mild intellectual disability and a suite of mental health and behavioural issues, had a “difficult history” with his mother.

Magistrate Greg Connellan said his sentence indication would be that upon a plea of guilty Mr Thirlway would not serve significantly more time beyond the 169 days he had already spent in custody.

He will face court again on August 10.
