A Springvale South man will spend more time behind bars after police allegedly found him with drugs the night before he was due to go into a residential rehab facility.

Daniel Young was refused bail at the Dandenong Magistrates’ Court on Wednesday after being charged with trafficking meth, careless driving and contravening his bail conditions.

The court heard Young was found at a Scoresby hotel, during his curfew hours, with 3g of alleged drugs and was one sleep away from being admitted to a residential rehab facility.

Young had also ramped up his drug use leading up to his admission in the detox centre, according to a corrections report, allegedly testing positive to GHB 39 times.

Prosecution submitted the case before the court was strong and Young should not be let out as he posed a risk to the community.

An alleged “tick list” was found, which had names of people who were “well known” to the court, and if Young were to be released, the prosecution said, he could impede their recovery.

Young’s lawyer submitted the alleged drugs were not actually drugs as they had yet to be tested, and argued the prosecution’s case was weak at best.

Magistrate Michael King said he understood why police had drawn the conclusion that the substances were drugs.

“Police found snaplock bags, a set of electric scales with white powder residue,” he said.

“I can see why police would think it was drugs.”

Mr King denied Young’s application for bail as well as the application to cancel the drug and alcohol treatment order — which he will have to continue for another 300 days.

Mr King advised Young to take advantage of the treatment on offer to build a “better life” and tend the cycle he finds himself in now.

“Resorting to not engaging in programs, getting into further trouble is not a way to address your issues and suggests an ongoing cycle of further offending and prison,” he said.

“Bare in mind the lessons you have learnt, put your attention to trying to address the underlying issues.”

He was sentenced to six months’ jail and was fined $100 for driving and possession of cannabis offences.
