The operator of a dentist in Melbourne’s southeast has landed in court following allegations it underpaid staff.

The operator of a Frankston dental clinic is being taken court over allegations it underpaid employees.

Seaford Dental Clinic operator Helix Bianca Nominees Pty Ltd faces a maximum penalty of more than $33,00 for allegedly failing to backpay two employees between 2014-20.

The Fair Work Ombudsman said that one worker, who was employed on a casual basis as a prosthetist between February 2019 and January 2020, was not paid weekday casual loading entitlements.

The group claims the other worker, who was employed as a full-time technician from April 2014 to April 2019, was not paid their accrued annual leave and leave loading entitlements when their employment ended.

“The ombudsman alleges the company, without reasonable excuse, failed to comply with the compliance notice which required the company to calculate and back-pay the workers’ entitlements,” a spokesman said.

Acting ombudsman Jeremy O’Sullivan said Fair Work is also seeking orders for the company to comply with the compliance notice, which includes rectifying any underpayments in full, plus superannuation and interest.

“Where employers do not respond to or comply with these notices, we will take appropriate enforcement action to protect employees,” he said.

The Federal Circuit Court will hear the matter on March 15.
