A drug-affected Peninsula party boy who met his match when the “soft target” of his terrifying attempted carjacking at a Frankston service station fought back, has been jailed.
Khial Smith, 24, was sentenced in the County Court on Thursday to a minimum two years’ jail after pleading guilty to attempted aggravated carjacking.
Smith attacked his victim “Jason” at the Caltex service station on Nepean Hwy on September 17 last year.
The hooded menace was off his head on GHB and meth and armed with an imitation handgun when he lunged at his victim just after 9.30pm.
Smith pointed the gun at Jason and demanded his car keys.
“Give me your f***** car keys c***,” Smith growled at his victim.
“You’re not getting my keys,” Jason yelled back.
Jason kicked Smith but the brute clobbered Jason with the gun and repeated his demands.
The pair tussled in the middle of the service station carpark.
Jason fought Smith off to a waiting getaway car, then followed the thug down the street.
Police identified Smith via CCTV pulled from the service station and other locations.
Investigators spoke to Smith at the Cheeky Squire Hotel carpark just after 3pm the next day but was he not arrested despite wearing the same clothes from the night before.
Smith was eventually charged on September 27 after being nabbed in a car in Mornington.
Jason fronted the media the day after the attack.
He said the ordeal felt like “something out of a Hollywood movie”.
“He was standing there … I got this funny feeling something wasn’t right and I thought (to myself) I’ll just watch him,” Jason said at the time.
“As soon as I tried to get into the car he pointed his gun at me.”
The court heard Smith has been unemployed since being sacked from his landscaping job more than four years ago.
Smith spends most of his time getting high with his mates on meth and the deadly party-drug GHB, the court heard.
The Dromana Secondary College dropout and ex-McDonald’s worker was on a community correction order when he attacked Jason.
Smith also has priors for drugs, weapons, theft and dealing with the proceeds of crime.
In March, Smith was jailed for eight months for reckless conduct endangering serious injury.
Judge Michael McInerney said the attack was a “terrifying experience” for the victim.
“This was a huge step for him (Smith) in regard to seriousness of criminality,” he said.
“Given the seriousness of this matter an attack upon an innocent member of this community means, as is not disputed, a jail sentence must be imposed.”
Smith – who had spent 70 days in custody – was jailed for a maximum four years.
