A man who sexually assaulted a teenage girl at the Lynbrook KFC is back on the streets.
Darren Ashe, 34, was sentenced in the Melbourne Magistrates’ Court on Friday to six months’ jail after pleading guilty to sexual assault.
However, Ashe was allowed to walk free from custody after already serving 187 days on remand.
The assailant was hunted by police after he sexually assaulted a 16-year-old girl in the toilet at the KFC Lynbrook in September last year.
The court was told Ashe had earlier been at the Lynbrook Hotel and Thirsty Camel bottle-shop before crossing over to the KFC.
Ashe asked KFC staff for a mask then left the store.
Ashe returned shortly later and asked to use the toilet.
A young woman entered the disabled toilet but Ashe was nowhere to be seen, the court heard.
The victim put her arm up to the toilet door after “someone” had attempted to gain entry.
Ashe then stormed into the cubicle and sexually assaulted the victim.
The victim kicked at Ashe, screamed and then elbowed her assailant.
Ashe then fled to a nearby Nando’s.
Police quickly established who their suspect was after receiving information Ashe had been banned from the Lynbrook Hotel.
Staff confirmed Ashe’s identity then handed over CCTV which linked the fiend to the area.
Police arrested Ashe at his Narre Warren South residence two days later.
Ashe rambled and continually changed the subject when quizzed by police, the court was told.
Ashe, who the court heard was under a Monash Health mental health treatment, was deemed “unfit” for interview.
Ashe, who also pleaded guilty to stealing a tip jar from a Casey Central store, was handed an 18-month community correction order.
