An alleged drug dealer caught busting curfew playing pokies nearly 100km from her home has been bailed thanks to her mum’s promise to dob in her daughter if she misbehaved again.
Nihal Guler was on remand facing a variety of charges including trafficking 30g of cocaine and had been told by a court to stay in her Marysville home every night.
But she ignored that curfew and was found by police at a Springvale hotel in the early hours of the morning.
She told cops she was “killing time” and was on her way to work at her mother’s Mornington kebab shop.
When officers asked her where she lived she was unable to provide the exact street number of the house she had been bailed to just three weeks before.
On Friday the 33-year-old mum appeared by video link at the online Dandenong Magistrates’ Court.
The court heard police officers were patrolling the Waltzing Matilda Hotel at 5.20am on December 31 last year when they saw Ms Guler.
They asked her why she was at a Springvale pub when she was supposed to be under curfew and living 94km away in Marysville.
CCTV showed she had been there for around two hours after signing in at around 3.25am, and she was arrested and remanded into custody.
Her defence lawyer said Ms Guler admitted the bail breach but hadn’t realised how serious her actions were.
She said this was her first time in jail, she had limited priors and was contesting some of the charges.
Her mother Yildiz Akdogan was also on the link to support her daughter and provide a new address to be bailed to.
She said she didn’t think she had “a big drug problem”, she would let her work at the kebab shop and she wouldn’t tolerate any drug use.
Ms Akdogan then swore that she would inform authorities if her daughter took drugs or did not abide by court conditions.
Magistrate Costas Kilias said the mum needed to know a few things about people addicted to substances.
“It is somewhat telling (Ms Akdogan) didn’t believe her daughter had a drug problem,” Mr Kilias said.
“She has lied to her mother, that’s what drug addicts do.”
He said he believed Ms Akdogan when she said she would inform authorities if her daughter breached any conditions.
Ms Guler was bailed to her mum’s Keysborough address, must abide by a night-time curfew and not use drugs of dependence.
