Mornington Peninsula man threw poo around Frankston police station cell, spat on custody officer

A Mornington Peninsula man who became agitated after being moved into isolation at Frankston police station has left officers with a disgusting mess, with the vulgar act coming after he participated in a disturbing case of animal cruelty.

A Tyabb man threw his faeces across a Frankston police station cell before spitting at an officer, a court has heard.

Ricky Jeremiah, 36 pleaded guilty in the Frankston Magistrates Court following the disgusting outburst which saw him strip naked before kicking the walls, defecating and throwing his faeces around on August 6.

Jeremiah continued the vile behaviour the next day by spitting on a custody officer as they passed a portable phone into his cell for him to use.

Jeremiah had been moved into an isolation cell after becoming aggressive with police following his arrest on August 5.

Police had caught up with him after he appeared at his father’s workplace at Hastings while wielding a dead pigeon on the end of a stick.

“(He told his father) I’m going to kill you, I have killed the bird and I am going to kill you,” the prosecution said on Tuesday.

The father locked his office door and called police before Jeremiah dented his car with the stick and ran toward Tyabb football oval.

Officers who apprehended Jeremiah said he appeared to be affected by drugs.

Jeremiah’s lawyer told the court her client suffered from an acquired brain injury and had been “in and out” of psychiatric hospitals throughout his 20s and 30s due to psychotic episodes.

He was also diagnosed with attention deficit hyperactivity disorder as a child and began using cannabis as a teen.

“(His) acquired brain injury affects (his) day to day functioning and ability to make rational decisions,” she said.

“(He’s) clearly no in his right state of mind …(but) shows his own insight in the need to seek treatment and assistance in his letter (to the court).

“(He acknowledges) he does need help managing mental health issues.”

Jeremiah told Magistrate Charles Tan he had been feeling “a lot” better since his arrest and wanted to help his mother at their farm as well as take his medication and begin exercising.

“There’s no excuse for threatening to kill people, spitting on police or custody officers when they’re handing you a phone or damaging property,” Mr Tan told Jeremiah.

“The key to you is the fact you’ve got to enjoy stable mental health.”

Jeremiah faces four charges including assaulting an emergency worker on duty.

He was bailed on the condition he attend his appointments at hospital and resides with his mother in Tyabb.

He will return for sentencing on Thursday.
