Mr Smith’s arrest follows the discovery of human remains in bushland beside the Frankston Freeway in Frankston North on Saturday.
The court heard Mr Smith had spent the past couple of nights in the Royal Melbourne Hospital after suffering what he believed to be a heart attack.
He did not apply for bail and was remanded in custody to reappear on December 16.
The human remains are yet to be identified.
City-bound traffic on the Frankston Freeway, between Cranbourne and Seaford roads, has been reduced down to one lane.
