A man who melted the valves off his housemate’s car tyres, a man caught riding his bike without a helmet and a mother-of-two found growing cannabis in her bedroom wardrobe have all fronted Moorabbin Magistrates’ Court.

Elisha Clarke

A Murrumbeena mother-of-two pleaded guilty to drug possession, after a police search uncovered a cannabis plant in the wardrobe of her family home.

Police were called to the home of 29-year-old Elisha Clarke on February 26 to follow up a separate incident.

After a conversation with Clarke, officers conducted a search of the home.

During the search, police found a marijuana plant in a wardrobe in her bedroom.

One cannabis plant was discovered alongside a hydroponic set up.

She was then arrested and taken to Bayside police station.

The police prosecutor said Clarke’s offending was “escalating”, as she had previously been charged with possessing a drug of dependence.

Clarke’s lawyer said she had been “trying to improve”.

.“Ms Clarke has made an effort to improve, and has registered with a job provider. She is seeking treatment for diagnosed PTSD, anxiety and depression,” her lawyer said.

Magistrate Starvaggi ordered Clarke be subject to a good behaviour bond.

Kane Osborne

A man has pleaded guilty to wilful damage of property after melting the valves of his housemate’s car in August.

The court heard Kane Osborne’s housemate went overseas for an extended period of time, and had approval from their landlord to leave the 2010 red Nissan Micra in the driveway of the shared property.

On August 22, the landlord asked Osborne to move the car, as his housemate was still overseas.

A short time later, the third housemate heard hissing noises from their room, and looked out the window.

The housemate saw Osborne levering the tyres of the Nissan with a tyre iron.

When they called out to Osborne, he told them to “keep out of it,” but left the car and went into the house.

He quickly returned with what the witness described as a “fire tool”, and watched Osborne melt the valves of the tyres off, rendering them unusable.

Emergency services attended the incident, where Osborne was interviewed by police.

Magistrate Starvaggi ordered Osborne to pay $400 in compensation to the owner of the car, as well as a $400 fine with conviction.

Alexander Filippis:

Alexander Filippis pleaded guilty to riding a bicycle without wearing a helmet and for riding a bike in an area with visible ‘no cycling’ signage showing.

On July 28, police were conducting safety operational controls at Oakleigh railway station, after reports of people riding bicycles in no-ride zones, creating safety issues for pedestrians.

Investigating officers saw Filippis ride through an underpass near the station, which provides access to train platforms and the bus/road networks on either side.

The underpass has clear visible markings, instructing bike riders to dismount and walk their bikes through the tunnel.

Officers approached Filippis to question why he was riding in a prohibited area

He told police he “didn’t have a reason”.

Magistrate Starvaggi ordered Filippis to pay $100, and be on a good behaviour bond until May 2023.
