A gym junkie who allegedly kicked a former partner in the groin, struck her dog multiple times and threatened to burn her house down has fronted court.
Brian Andrew Duyn is also accused of menacing the woman by driving his car onto a nature strip, stopping just metres in front of her.
The Noble Park 37-year-old appeared at the online Dandenong Magistrates’ Court on Tuesday, pleading not guilty to charges including unlawful assault and assault with a weapon.
Police say Mr Duyn went to the alleged victim’s Pakenham house at around 6am on June 20 last year, waking the woman up.
They argued before he allegedly got on top of her and held her down on her bed in an effort to try and get her phone.
When the woman’s dog began barking, he got up and allegedly kicked the animal eight to 10 times and then kicked the woman in her groin, badly winding her.
He left and she walked towards her neighbour’s house.
Mr Duyn got in his car and allegedly drove towards the woman, his vehicle mounting the kerb and onto a nature strip before stopping just short of her.
He then drove off, but 20 minutes later he is alleged to have returned with a jerry can and threaten to burn her house down.
Police say they have CCTV evidence of the car from outside the home, and a neighbour’s statement saying the woman came to them doubled up in pain.
Mr Duyn’s lawyer said there were “factual disputes over what occurred” and his client is contesting the charges.
Magistrate Tony Burns said there were concerns over whether or not the case should be uplifted to the County Court as a potential jail term, if he was found or pleaded guilty, “could run into years, not months”.
He said Mr Duyn “was kidding himself” if he didn’t think he needed to seek further advice from a legal counsel regarding jurisdiction.
He also asked the police to consider looking into laying a charge of animal cruelty.
Mr Duyn will return to court on June 11.
