A homeless man high on ice who lured a woman to an abandoned house and repeatedly raped her referred her as “Rose” and “baby” during the ordeal.
Agwa Obiech, 30, took out a pipe from his trousers and made his victim take two puffs during his 90-minute attack as the woman shouted for help from a toilet window.
Obiech pleaded guilty to a charge of rape and was sentenced in the County Court on Thursday to seven-and-a-half years in jail.
Judge Fiona Todd said Obiech met his victim at a park in Dandenong in February 2021 and asked if he could go to her place.
She refused but agreed to return to his house.
However, Obiech instead took the woman to an abandoned house across the road from the park.
When he began touching and hugging her, the woman tried to leave, pushing Obiech away, but he kicked in the back of her knees and raped her.
To try to escape, the woman asked to go to the toilet.
Obiech accompanied her and once inside the bathroom, she repeatedly screamed for help from a window.
He broke open the toilet door and took her back to the room and raped her again.
Then took out a pipe from his trousers and made her take two puffs and rubbed an unknown substance on her lips.
“You referred to her as ‘Rose’ and ‘Baby’. She submitted to this out of fear you’d harm her. She also told you she’d not report the matter to police,” Judge Todd said.
Obiech eventually walked her home and asked when they would meet up again.
“Your offending was enduring, persistent and you continued to overwhelm her physically throughout. You acted to fulfil your own desires while totally disregarding her,” the judge said.
Obiech had been drinking, abusing ice, had stopped mental health treatment and was homeless at the time, she said.
Obiech told a psychologist he was heavily intoxicated at the time, sought intimacy and was unaware of consent.
Judge Todd said Obiech’s claim that he was unaware of consent was problematic, given his five penetrative acts were accompanied with further violence and preventing her from leaving.
Obiech will be eligible for parole in four-and-a-half years.
