A Melbourne man has cried his eyes out after he was banged up for allegedly abusing cops and smashing up a police car.
Declan Bailey, 21, fronted Dandenong Magistrates’ Court on Thursday charged with obstructing an emergency worker, affray and criminal damage.
Bailey, who was also charged with driving while disqualified and indecent language, allegedly approached police observing a hoon meet at Springvale MegaCentre on October 8.
The MegaCentre is a known meet-up place for hoons with events happening most Friday and Saturday nights, the court heard.
Bailey allegedly walked back and forth across a pedestrian crossing as the police car approached the MegaCentre carpark.
It’s alleged Bailey attempted to stop police cars from entering the carpark.
Police will allege they told Bailey to move but he didn’t listen.
Bailey eventually moved and the officers were able to go through before the accused menace interrupted them again at the exit.
Bailey allegedly shouted to the crowd “someone get this on Snapchat” and “this one time at band camp, these cops stuck it through my vagina” while he was being arrested.
Police allege a woman was standing in the crowd with her two-year-old son and was worried.
Bailey, of Cranbourne North, was again allegedly front and centre with cops at a Pakenham hoon meet on October 11.
It’s alleged Bailey and co-accused Hayden Osbourne were spotted by police at the Hogan Court street meet.
Bailey and Osbourne allegedly stood in front of the car, preventing it from going any further then took out their mobile phones and began recording.
“Are you f---ing kidding me? Bro, what are you doing,” Bailey allegedly shouted at police
The officer tried to steer away from the pair before Bailey leaned against the car and said “stop f---ing driving c---”, the court was told.
Bailey allegedly hit and kicked the police car before pulling the front registration plate down and causing “significant damage” to the bumper.
The court heard a police officer in the car said in a statement they “felt fearful they were going to be assaulted”.
After the incident, a grandmother who was in the area at the time approached the officers with her eight-year-old grandson and said she was “petrified” by the behaviour.
She also said she saw the men surround the car and punch it.
The incidents were both captured on police cameras.
Hardened Victoria Police crew Dandenong Achilles Taskforce members arrested Bailey and Osbourne during early morning raids on November 17.
Operation Taskforce was formed to target hisk risk drivers and other “persons of interest” in Melbourne’s hoon scene.
Osbourne was bailed to front court at a later date but Bailey was interviewed and remanded in custody.
Bailey, who appeared via videolink from the Dandenong Remand Court made a late play for bail.
The court heard, Bailey, when asked about why he was walking across the pedestrian crossing, said he didn’t know it was a police vehicle because he wasn’t “wearing his glasses” and that he was “just being silly”.
The defence submitted Bailey’s first time in custody would be made “more onerous” on him due to his “severe eating disorder” and mental state.
Mum Glennys Bailey told the court her son was on a restrictive and controlled diet which means he can’t eat foods “outside of his acceptances”.
Mrs Bailey, who told the court she would put forward $5000 if her son was granted bail, said she would keep the car keys in a safe or “off site” so her son couldn’t drive.
Bailey, who cried during the hearing, was remanded overnight while the court deliberated his application.
“I need time to read the documents, I don’t want to rush the decision otherwise Mr Bailey you can be reasonably confident you will stay in custody,” the magistrate said.
Bailey, who spent a night in custody, was bailed on Friday with strict conditions including he report to police and not post any hoon related material on social media.
