Woman confronts her husband’s mistress following repeated obscene phone calls

An angry wife who attacked her husband’s mistress after enduring repeated smutty phone calls detailing the cheating duo’s sexual escapades has had the last laugh, with assault charges dismissed — and the magistrate made a surprise suggestion.

A woman taunted by her husband’s mistress with cruel phone calls detailing the lewd acts they were getting up to behind her back has had assault charge against her dropped in court after attacking the woman.

Magistrate Timothy Walsh dismissed charges of recklessly causing injury brought against mother of two Helen Johnston, 55, at the Ringwood Magistrates’ Court earlier today.

The court heard Ms Johnston confronted her husband of 33 years and the father of her children while he was having dinner with his lover at a Thai restaurant on Burwood Highway in Wantirna South on New Year’s Eve last year.

A terse conversation between members of the group quickly lead to Ms Johnston picking up her husband’s phone from the table and throwing it at the woman’s face, causing minor bruising and swelling.

Ms Johnston’s defence told the court the mistress would repeatedly call Ms Johnston during the day from her lover’s phone and describe to her in detail the sexual acts they did together.

At times she said Ms Johnston was subjected to between six or seven disturbing phone calls a day, and eventually her client had enough and lashed out.

Mr Walsh said he understood Ms Johnston’s motive but he suggested the phone may have been better aimed at her cheating husband.

“She should have hit her husband, not the complainant,” he said.

But he said there was no need for violence, and while he accepted Ms Johnston’s guilty plea he dismissed the charges.

“Look, I get it, but we don’t behave like that,” he said.

“I understand the circumstances and what lead you to do it.”
