An angry tradie has dodged jail after breaking an older shopper’s nose in a fiery bust-up at Bunnings over an out-of-control dog.
Khaled Hamed pleaded guilty to an assault related charge at the Heidelberg Magistrates’ Court on Tuesday.
In March this year, the 24-year-old plumber was at Bunnings in Thomastown with his wife and his German Shepherd puppy when the pup became out of control.
The dog escaped Hamed’s wife’s hands and jumped onto another shopper.
The shopper — a man in his 60s — told the couple to “control their effing dog” after they apologised to him.
The court heard the shopper and Hamed’s wife started to argue before Hamed punched the man in the face.
A photograph of the victim, shown to the court, revealed the extent of the broken and bloody nose caused by Hamed’s punch.
Hamed’s lawyer told the court his client had acted in “self-defence” when he punched the shopper.
He claimed the shopper had rushed towards the couple — while holding paperwork in his hands — and was why Hamed “pushed and punched” him in “self-defence”
But Magistrate John Bentley rejected Hamed’s self-defence claim after watching CCTV footage of the assault.
“To punch someone in the face in that manner, that is not self-defence,” he said.
“This bloke has a broken his nose. Your guy is going to jail if he is not going to plead guilty today.”
Hamed’s lawyer told the court his client was the sole owner of a plumbing business.
Hamed will undergo an anger management course.
He received a deferred sentence without conviction and signed a good behaviour bond.
