Heidelberg West David Clancy of accused of trafficking heroin

A man was allegedly caught high behind the wheel loaded with drugs and money — and his one-year-old daughter during a police intercept in Preston.

A man was allegedly drug-affected when caught driving with his one-year-old in the car, along with more than 50g of drugs and more than $11,000 cash.

And police made the find just months after the man was hospitalised when he caused a crash while on drugs, where almost 80g of drugs were found in his car.

Police argued David Paul Clancy was a serious risk to safety of his daughter and the community when he applied for bail before Heidelberg Magistrates’ Court on Friday, June 26.

The court heard police allegedly pulled over a BMW they’d seen travelling fast on Laurel St, Preston about 5.33pm on May 4, finding the 40-year-old sweating behind the wheel.

His one-year-old daughter was in the car and he was allegedly wearing a satchel containing 22.68g of methamphetamine, 18.67g of heroine and $11,290.10 in cash.

Police allegedly found 10g of cannabis with baby clothes in a baby bag, digital scales in the driver’s door and a glass pipe between the front seats.

The Heidelberg West man was on bail following a vehicle collision on Outhwaite Rd, Heidelberg West about 3.12pm on August 23, which led to him needing to be admitted to hospital.

The court heard Clancy allegedly gave a false name at the scene and tested positive to having drugs in his system, before he was charged with driving in a manner dangerous and careless driving.

Police allegedly found 59g of methamphetamine in his car, 18g of heroin and $5208 cash.

The court heard Clancy was facing five charges of drug trafficking among other charges.

The prosecution told the court there were no conditions that could mitigate the risk of Clancy, who had been in custody for 53 days since his arrest, being released on bail.

Magistrate Jennifer Tregent said there was no hope of him getting bail, saying she found it “remarkable” Clancy had been released after his arrest in August.

“I’m not too sure why we’re here,” she told lawyer Chris McLennan six minutes into the application.

Mr McLennan proposed Clancy only be bailed to go to residential drug rehabilitation, saying he also had mental health issues.

But Ms Tregent said the “horse (had) bolted”.

She said the alleged crimes meant Clancy was a danger to the community, and he was facing allegations of high-scale trafficking.

“That’s significant quantities of drugs, worth a lot of money,” she said.

Ms Tregent said the father should expect to spend a significant amount of time in jail.
