A man had to be detained by members of the public after he escaped from the clutches of police, despite having been capsicum sprayed and repeatedly hit with batons.

Adrian Kodasinski tried to flee from police after they found him vacuuming a stolen car at A Heidelberg West car wash, while wearing gloves and carrying methamphetamine.

He fronted Heidelberg Magistrates’ Court on Tuesday, July 21, having been locked up for 96 days since the incident occurred while he was on a community corrections order for similar offending.

The court heard police saw the qualified personal trainer and mechanic at a car wash on Waterdale Rd, Heidelberg West, about 3.15pm on April 15, vacuuming a car with gloves on.

Their checks discovered the car had been stolen the day before.

When they asked to see Kodasinski’s ID, he picked up his backpack and ran.

Leading Senior Constable Grant Smith said police and a member of the public caught up with him as he tried to jump a fence across the road from the car wash.

Kodasinksi heavily resisted as police tried to restrain him, with officers striking him with a baton multiple times and using capsicum spray.

The court heard police were unable to get him into handcuffs before Kodasinski grabbed an officer’s hand, then managed to run away again.

Senior Constable Smith said several members of the public stopped Kodasinski as he ran along Northern Rd, holding him for police.

Police found 3.8g of methamphetamine in his backpack, as well as multiple pairs of mechanics’ gloves, believed to be used for crime.

The court heard the unemployed Reservoir man had been put on a corrections order for similar crimes — running from police, possessing methamphetamine and possessing a stolen motorbike — in January.

His lawyer told the court Kodasinski had relapsed into methamphetamine use before the incident, and had gone on to complete drug rehabilitation programs while in custody.

On Wednesday, July 22, Magistrate Helen Murphy sentenced Kodasinski to the 97 days he had already spent in jail, releasing him on his existing corrections order as well as a second 12-month corrections order.
