Epping Coles Express: Man seeks refuge after alleged attack

A man was allegedly forced to flee his Epping home after curfew after his girlfriend violently attacked him in bed. She suspected he’d been doing the dirty on her in lockdown.

An enraged woman allegedly left her boyfriend needing to go to hospital after she attacked him in bed at his Epping home because she believed he had been cheating.

The Mill Park woman allegedly woke him by screaming, before she bashed him in the face with a can of bourbon and punched him to the head, a court has heard.

The alleged attacker couldn’t appear before Heidelberg Magistrates’ Court on Tuesday, September 1 after spending a night behind bars, with the woman said to be displaying symptoms of COVID-19.

The court heard she had been at her boyfriend of about six months’ Epping home the night earlier when she became angry at him, believing him to be having an affair.

He was allegedly asleep in bed about 10pm when she started screaming and yelling at him, then hit him to the side of the head with a can of bourbon multiple times, injuring his face.

She allegedly threw the can across the room and punched him in the head before he managed to get out of the house and seek refuge in a nearby Coles Express, where he called his ex-partner for help.

The ex-partner allegedly called emergency services, with police finding the man in the convenience store and then taking him to Austin Hospital about 10.40pm.

Police allegedly found her back at his house with blood on her face, which was not hers, with the woman being uninjured.

Police told the court she was on bail at the time of the alleged incident and had an exceptionally violent history, including convictions for recklessly and intentionally causing injury, hindering and resisting police and various forms of assault.

Lawyer David Rofe applied for bail in the woman’s absence, saying the charges would be contested and would take some time to resolve, meanwhile custody would be particularly onerous because of COVID-19 restrictions and her anxiety disorder.

Mr Rofe said the photos of the man’s injuries didn’t correlate with what was alleged to have happened, saying it looked like the man had been scratched under the eye with fingernails.

He suggested the alleged attack may have in fact been self defence, with the man not being the one who called police.

Magistrate Denise Livingstone agreed there would be a delay in sorting out the matter, saying the risk of bailing the woman could be made acceptable by strict conditions, and granting an interim intervention order to protect the man.

She banned the woman from drinking alcohol, taking drugs and contacting the man.
