Anthony Giammarco, 31, Reservoir, fronted the County Court on Tuesday when he was sentenced to 204 days’ imprisonment after pleading guilty to a raft of charges, including discharging a shot at premises and affray.
But he’ll be out in 10 days with 194 days reckoned as time served, and will then be on a community corrections order.
The court heard that Giammarco arrived home with his mother and two men about 8.15pm on November 19, 2024 and yelled for the two burglars he had seen on CCTV to come out.
He had a shotgun while two others were allegedly armed with a metal pole and an axe.
Giammarco then discharged one round into the lounge room window. One of the men with him said “Another one coming, get out of the f-----g house” but Giammarco was unable to reload the gun
Neighbours heard people arguing after Giammarco entered his house and called emergency services.
“While it is true that the people who entered your premises had no entitlement to do so, you cannot take matters into your own hands, as you did,” Judge Gabriele Cannon said.
“Especially in the way that you did, which was extremely dangerous. You should never have been in possession of a firearm in the first place, much less fire it into the house in circumstances where you knew people were there”.
Judge Cannon said Giammarco had a number of previous convictions, mostly for driving and drug matters including a stint in jail.
In 2019, firefighters had to cut him out of his work van after he crashed it into a tree on Ballarat Rd, Maidstone, after consuming methamphetamine.
He was sentenced to three months’ imprisonment.
Two years later, the father-of-one was fined $20,000 after faulty plumbing works caused water leaks in a city apartment building.
