Alexander Talevski sues his mate in the Supreme Court

A plumber who lost a leg in a car crash is suing his mate for driving at an excessive speed after smoking weed and causing an accident in Kealba that nearly killed him.

A Melbourne plumber who lost a leg in a horrific crash is suing his mate for speeding after smoking cannabis and causing the near-fatal accident.

Alexander Talevski was one of two passengers in a modified Nissan Skyline driven by a drugged-up Nicholas Sevdalis on the night of January 4, 2022 when the car spun out of control, before crashing and splitting in two, on Sunshine Ave in Kealba.

The car was given to Sevdalis by his grandfather and the trio went for a spin, reaching speeds of more than 135km in an 80km/h zone, when the crash happened.

Mr Talevski’s mangled right leg had to be amputated above the knee and he suffered other serious injuries, including open skull fractures.

In November, Sevdalis was jailed for a minimum of 10 months after earlier pleading guilty to charges of negligently driving causing serious injury, recklessly causing injury and recklessly driving at an excessive speed under the influence of cannabis.

In the statement of claim filed in the Supreme Court, his lawyer Angus Macaskill said Sevdalis owed Mr Talevski a duty of care and not to expose him to unnecessary or unreasonable risk of injury.

He said Sevdalis failed to warn Mr Talevski that the former was driving under the influence of cannabis, drove at a grossly excessive speed, failed to take reasonable care and swerved between lanes.

Further, he said Sevdalis drove the vehicle with prohibited modifications on a public road and in a manner that exposed Mr Talevski to a foreseeable risk of injury.

Mr Talevski is seeking damages for past lost earnings, future loss of earning capacity to

retirement age, and lost superannuation.

Mr Macaskill said prior to the crash, his client was working as a qualified plumber but has been unable to return to work in any capacity.

The Supreme Court is yet to set a hearing date.

During sentencing in the County Court, Judge Frances Hogan said it was miraculous no one else was injured or killed as a result of Sevdalis’ reckless behaviour.

His driving licence had either been cancelled or suspended on seven occasions prior to the crash at Kealba.
