Somerton P-plater loses licence for two years after smashing into motorbike
A Somerton P-plater was not only driving on the wrong side when he smashed into an oncoming motorbike, the teen then refused multiple orders from officers to be taken to the nearest police station for breath-testing.

A 19-year-old P-plater who smashed into an oncoming motorbike and later refused to accompany police for further breath tests has been stripped of his licence.
Dylan Day pleaded guilty in the Broadmeadows Magistrate’s Court on Thursday to careless driving and refusing to accompany police.
Leading Senior Constable Jasmine Hill told the court the Somerton teenager drove his BWM sedan on the wrong side of Cleveland Dve in Cragieburn when he smashed into a motorcyclist about 5.15am on February 17 last year.
The male victim was flung from his motorbike, but did not sustain any injuries.
Initial breath test results showed Day had alcohol in his system, but he refused multiple demands by police to be taken to Cragieburn police station for further tests.
At the time he said “I am not coming, I am not intoxicated, I am not under arrest so I am not going”.
He also told police: “if you are happy I can come tomorrow to the station, but I am not coming today”.

Magistrate Olivia Trumble banned Day from driving in Victoria for two years.
“You took a position in terms of considering you weren’t under arrest and didn’t want to go and thought that was your right, but you understand now that it is your right but then you face the charge of refusing to accompany the police,” she said.
Mr Day was also hit with a 12-month good behaviour bond.
