Two Melbourne men exchanged messages about a plan to “blow out” or spike a woman’s drink with GHB before raping and filming the depraved acts which they then shared with their mates.
Rhys Scerri and Leigh Lincoln fronted the County Court on Tuesday for sentencing after earlier pleading guilty to their roles in the offending that took place in September 2020.
In a separate offending, the court heard that Scerri raped and impregnated a woman who was affected by drugs in March 2020.
Scerri was sentenced to 14 years’ imprisonment on three charges of rape and given that Lincoln has already spent 570 days in custody on one charge of sexual assault, it was deemed time served.
Lincoln filmed Scerri raping a naked and unconscious woman and the video was circulated among their group of friends and eventually provided to police.
Judge Wendy Wilmoth said the first rape happened in late March 2020 when the victim was affected by drugs. Scerri moved his hand on her hip area and then on to her vagina over her shorts, despite her saying no and telling him to stop.
Scerri then started kissing her, climbed on top of her and raped her. Scerri said “I thought you wanted it”. She said “No, f--- off”. I said no and tried to push you off. How come you think I wanted it?
Judge Wilmoth said the victim became pregnant and DNA results were consistent with Scerri being the father.
In September 2020, the judge said Scerri and Lincoln exchanged text messages about meeting that night with a plan to “blow out”, meaning to spike a woman’s drink with GHB and then both could “go nuts”.
The plan went ahead and Lincoln filmed Scerri perform sexual acts on the naked, face down and unconscious woman.
“Not only was there no consent but the complainant was deliberately rendered unconscious in order for the sexual acts to be performed on her,” Judge Wilmoth said.
She said the use of GHB has become the modus operandi of Scerri to subdue women to submit to his sexual predation.
“The making of a deliberate plan indicates a shameless determination to subject a woman to debasement for his sexual gratification at a time when the woman was at her most vulnerable, being unaware and being utterly unable to object or to resist.
“When questioned by police, Mr Scerri denied the woman in the video was the complainant and denied it was circulated to police, indicating an attitude bereft of empathy or remorse.”
Scerri will be eligible for parole after serving 10 years.
