Family violence: Theodoros Bambalis jailed for stalking former partner

A man who repeatedly assaulted, stalked and intimidated the mother of his child — even while he was in police custody — is now behind bars for the thirteenth time.

A man who repeatedly assaulted, stalked and intimidated the mother of his child — even while he was in police custody — has been jailed for four and a half years.

Theodoros Bambalis, 50, went as far as to make calls to his son from custody to tell him to assault his mother to get her to withdraw charges against him, Judge Hogan told the County Court at sentencing.

The court heard Bambalis had previously been in prison 12 times, including for assaulting the mother of his child — his former partner of 19 years — between May and July, 2017.

Judge Hogan said the former heroin addict made “various explicit threats to assault, sexually assault or kill his ex partner via hundreds of calls and texts, including 104 calls in one day.

Bambalis told the woman he had a mate with a gun watching her, and threatened her male partner and mother, the court heard.

He told police he planned to attack her if he was ever released after he was arrested on June 8, 2017, when police also found 10 small cannabis plants at his Taylors Lakes house.

Judge Hogan said Bambalis made “persistent” calls to his son from custody in July, insisting he pass on abuse and threats to get his victim to drop the charges against him.

He also encouraged the 19-year-old to assault his mother so she would withdraw her allegations.

The court heard Bambalis had a 31-year criminal history, including charges for unlawful assault, drug and driving offences, and an incident in August 2016 when he stalked his former partner before surprising her at a bus stop and hitting her in the head several times.

Judge Hogan said Bambalis’ repeated willingness to breach the court order and the “repulsive, dehumanising, sexually abusing terms” when referring to his victim were gravely concerning.

“A message needs to go out to all those who think that they can stalk, intimidate, harass and threaten their current or former intimate partners,” she said.

“This bullying, menacing and overbearing conduct simply will not be tolerated.”

“Perpetrators … do not own those with whom they have had intimate relationships.”

The court heard Bambalis had a long history of substance abuse, and “poor” rehabilitation prospects.

He was charged with stalking, cultivation of a narcotic plant and attempting to pervert course of justice.

He will not be eligible for parole for at least three years.
