A taxi driver who bashed his former partner because he was tired and he didn’t like her talking to his dad escapes jail time

A ‘tired’ taxi driver who beat his former partner twice in five days has avoided jail for his “vile” assaults, because he was remorseful and had done a men’s behaviour program.

A “vile” woman basher who violently attacked his former partner twice — once because he was tired, and a second time because she phoned his father — has been spared jail.

Instead the Lyndhurst taxi driver will have to do community work and undertake alcohol counselling to try to control his rages.

Raghbir Sran, 28, pleaded guilty to two assault charges at Frankston Magistrates’ Court yesterday.

The court heard Sran and his partner were at their then home on the afternoon of September 2 last year when the woman asked him to go and do some taxi work.

But he said he was tired and flew into a rage, punching her in the head and kicking her in the chest.

She suffered bruising and a bleeding ear in the 10-minute assault.

Just five days later he had been out drinking when he came home to hear the woman talking to his dad on the phone about the previous incident.

He berated her, saying “how dare you talk to my father without my permission” before punching her three or four times to the head and ripping off her shirt — all while the woman’s friend screamed at him to stop.

The two women ran out the house and reported the attack to police.

In court Sran’s defence lawyer said he now understands the “stupidity and foolishness” of the “regrettable” violence he inflicted upon her.

He said he was remorseful, had done a men’s behaviour program of his own accord and was now living apart from her, although he did hope to reconcile.

He asked for a no conviction to be recorded, saying Sran was on a bridging visa which could be adversely affected by a finding.

But magistrate Vicky Prapas said a conviction was certainly warranted, and his remorse, lack of priors and plea of guilty were the only things saving him from jail.

“Your behaviour on these two occasions, violently assaulting your partner, is unacceptable,” Ms Prapas said.

“This violence is vile.

“(It was) towards a woman you say you care for, you say you love, it is not appropriate.”

Sran was convicted and sentenced to a 12-month community corrections order, must do 150 hours of unpaid work and attend alcohol counselling.
