Swan Hill Magistrates’ Court: Bryce Delmenico denies allegations that he pulled his penis out in public to flash an elderly woman

A Swan Hill woman using a walker has alleged a trio of men harassed her in a public street with one allegedly flashing his penis at her, a court has heard.

A Swan Hill man has denied allegations that he flashed an elderly woman in the street despite telling police he “couldn’t remember the night”.

Bryce Delmenico appeared in the Swan Hill Magistrates’ Court on November 16, over allegations that he exposed his genitalia to a 68-year-old woman using a walker in May.

The court heard the woman was walking down Campbell St on May 20, before coming upon Mr Delmenico and two of his friends.

The woman alleged the trio approached her as she walked closer to them, when Mr Delmenico allegedly pulled his penis out of his pants and gestured towards the victim.

He allegedly verbally harassed the victim saying “suck his c--k, go on”.

The incident was caught on three CCTV cameras from surrounding properties.

The woman alleged that Mr Delmenico and his two friends also blocked her from passing them on the path.

The court heard Mr Delmenico told police he “didn’t remember the incident”, but identified himself in a still taken from the CCTV footage.

“I was drinking a fair bit,” he said.

“I would tell you what happened, I would if I could but I honestly can’t.”

Mr Delmenico's lawyer Damon Pica said his client wasn’t denying there was an interaction, but denied that he pulled his genitalia out of his pants.

Magistrate Sharon McRae reviewed the CCTV footage in chambers, saying from her perspective, the footage was “consistent with the victim’s version of events”.
“He’s put his hands in his pants and he gets very close to her,” she said.

“I think if it was blown up, from what I can see, it looks like he is holding his penis in his right hand.”

“If he’s not pulling his penis out, I don’t know what he’s doing.”

Ms McRae said the behaviour of Mr Delmenico’s friends also supports the allegations.

“The reactions from the other two people there – they’re clearly extreme,” she said.

“They’re doubling over in laughter. That is consistent with something more than merely him saying something to her.”

Mr Pico asked for a further adjournment to have the footage reviewed and enhanced to prove whether or not Mr Delmenico pulled out his penis.

“If he makes a 68-year-old victim come and give evidence, he will lose absolutely every discount to a sentence,” Ms McRae said.

“A discount could be the difference in whether or not he goes to jail.”

Mr Delmenico will return to court on February 6 next year.
