Mildura Magistrates’ Court: Chloe Hibbard ‘given another chance’ after attempting to assault police

A woman was so out of control when confronted by police they had to use OC spray, but it didn’t do a thing so cops were forced to bring out the taser.

A Mildura woman who tried to attack with knuckle dusters and spat at them had her poor mental health taken into account during her sentencing.

Chloe Hibbard pleaded guilty in the Mildura Magistrates’ Court to a charge of attempting to assault an officer when police were called to an address several weeks ago and found her out the front armed with knuckle dusters and yelling.

Hibbard attempted to hit one of the officers with the knuckle dusters, chasing him around the front yard and threatening to spit on him before police used OC spray.

The spray had no effect on Hibbard who was then tasered so that she could be handcuffed and taken to the police station.

Once Hibbard was taken to the police station she was asked to explain her actions and she said, “I have borderline personality disorder, what do you expect from me.”

Magistrate Patrick Southey took into account that she was having a mental health episode which “reduced her moral responsibility” for her actions.

“She suffered extra-curial punishment as it’s called by being sprayed and tasered, and given her mental health at the time her moral responsibility is obviously reduced,” he said.

Ms Hibbard’s lawyer Hugh Middleton told the court since the incident she has taken steps to better manage her mental health.

“She seems to have her mental health in hand, she sees a GP regularly and she has been put on a mental health care plan,’’ he said

Mr Southey acknowledged how terrible the incident was but the steps she had taken since gave her the chance to avoid a conviction.

“I’ll give you another chance to avoid a conviction but it was a terrible incident; it sounds like you were completely out of control,” he said.

Hibbard was given a 12-month good behaviour bond.
