Mildura Magistrates’ Court: Ashley Andrew pleads guilty to drink driving and driving without a seatbelt on

A Mildura man who had tipped back more than a few frothies at his local footy club rolled his car after he tried to avoid a kangaroo.

A Mildura man rolled his car while trying to avoid a kangaroo after a boozy evening at his local footy club.

Ashley Andrew, 62, pleaded guilty in the Mildura Magistrates’ Court on November 21 to drink driving and driving without a seatbelt on, after he rolled his car on the way home from a footy match.

The court heard police were called to the scene on June 3 where they found Andrew’s car on its side and Andrew “bleeding profusely”.

Paramedics also attended, taking Andrew to the Mildura Base Hospital, where a blood test revealed he had a blood-alcohol level of 0.178.

Andrew told police he’d been drinking at the local footy club that evening, making full admissions to drinking and driving.

He told police he “didn’t think” he had been wearing a seatbelt at the time of the accident.

The court heard Andrew had been at the footy club after a “fairly long day” and had swerved to avoid colliding with a kangaroo on his way home.

Magistrate Michael McNamara said he “should have known better”.

“It’s a serious thing to drink and drive, especially with that kind of reading,” he said.

“You were a danger to yourself and others in the community.”

Andrew was convicted and fined $1000 for drink-driving and convicted and fined a further $300 for driving without a seatbelt.

His licence was cancelled and disqualified for 17 months.
