Hussain Ali Allami: Mildura driving while disqualified offender off roads for Christmas

A driver who has been repeatedly nabbed driving without a licence has been caught behind the wheel again – just five days after a four-year ban.

A repeat offender with a string of offences for driving while suspended or disqualified has run out of chances.

Hussain Ali Allami, who has a fruit block in the Mildura area, pleaded guilty at Mildura Magistrates’ Court on Monday to charges that included driving while disqualified.

The court heard on October 18 police stopped Allami driving on Dairtnunk Ave in Cardross, near Mildura.

Allami told police his licence was at home.

But in fact Allami had been in court just five days earlier, when he was disqualified from driving for 48 months.

Other matters heard on Monday included an April incident when Allami was stopped in Mildura driving while suspended.

A preliminary oral fluid test was conducted, with police asking Allami to accompany them for further testing.

Allami responded: “No, f**k off.”

During the same month, Allami was once more pulled over before failing to accompany police for an oral fluid test.

In March, Allami was detected in Mildura’s Etiwanda Ave driving 87km/h in a 60km/h zone.

His licence was found to be suspended at the time due to a loss of demerit points.

Magistrate Michael Coghlan said Allami was one of the worst offenders he’d had to deal with.

Mr Coghlan said Allami had received both jail time and community corrections orders for driving while disqualified or suspended before, with incidents in 2011, 2012, 2013, 2015 and 2020.

“You just don’t care,” Mr Coghlan said.

Allami responded: “It’s not that I don’t care your honour, but I got kicked out of home.”

He was sentenced to a total of six months in jail, fined $1000 and is now disqualified from driving for five years.

Allami’s lawyer indicated the sentence would be appealed.

Mr Coghlan denied an application for appeal bail, saying there was “clearly” an unacceptable risk of further offending if released.

He said there was also an unacceptable risk to others were Allami to return to the road over the Christmas period.

The court was told one of Allami’s preliminary oral fluid tests indicated an illicit substance was in his system.

Mr Coghlan told Allami if he was released with a condition not to drive “I’m certain you would ignore it and continually drive a motor vehicle”.

Allami “won’t listen”, the magistrate said, referencing the time between his October court date and further offending.

“I warned you,” Mr Coghlan said.

“I said to you (if you drive again) you will go to jail and I’m wondering now if you remember that Mr Allami.”

The appeal was listed for February 3.
