A Cockatoo man who hit a father over the head with a glass stubbie and broke his son’s arm will not spend further time in prison, a court has heard.

Max Jorgensen, 29, faced the County Court on Monday via video link from his car after earlier pleading guilty to two charges of recklessly causing injury over a 2020 assault.

Court documents show Jorgensen was walking through the Boronia Cres area in search of his dog about 10pm on March 21, when a man smoking a cigarette saw the silhouette of a figure approach his house with a torch.

The man called out to his father, saying that someone was on their property, and told the person to “f*** off and keep moving”, to which Jorgensen answered that he was looking for his dog.

The older man stepped outside and asked Jorgensen what he was doing. Receiving no reply, he told him to leave his property.

The documents show Jorgensen — who was carrying a stubbie — appeared to be texting someone and had moved closer to the house, prompting the older man to move forward and shove him.

Jorgensen then punched the man in the face, knocking him to the ground, before running towards the nearby railway line.

He was tailed by the father and son, who pursued him for a distance before returning to their home.

Once inside the son called Triple-0 but while on the phone he heard “a commotion”.

He stepped outside to see his father fighting with two men on their driveway.

The documents state Jorgensen believed he had been struck with a wooden pole and retaliated by swinging a beer bottle across the man’s head, causing it so shatter, before the tussle continued.

At this point the older man yelled out to his son to “get the gun” before Jorgensen struck the younger man with the pole — it first connected with his arm and then his head.

The pair retreated inside their home, though Jorgensen remained on the property and shouted at the pair to go back outside.

The documents show a nearby resident called Jorgensen just after 11pm as she had found his dog on her property, but it ran away at the sound of “aggressive yelling”.

Police found the “heavily intoxicated” Jorgensen lying in a drainage ditch on Boronia Cres about 12.30am.

During an interview he told police he had drunk about six beers before he started looking for his dog.

He said he crossed the train line during his search and found himself on their property, that had no fence, and claimed he acted in self-defence after being hit with a pole.

The prosecution accepted he hit the father with the bottle in self-defence and this incident was not charged.

Jorgensen is charged with throwing the initial punch that knocked the father to the ground and striking his son with the pole, resulting in a wrist fracture.

Prosecutor Andrew Buckland said the victims were “skeptical” about the lost dog story and feared he was on their property for another reason. He said the effect on them was “long lasting”.

Judge Cahill on Monday stated he would be released on a community corrections order — for which he had been deemed suitable — when sentenced later this week.

He served 48 days in prison before being released on bail.
