A violent 20-year-old Dandenong man who kicked a beloved Seaford tradie in the head moments after he was fatally stabbed has appeared in court again.

A 20-year-old Dandenong man who kicked a beloved Seaford tradie in the head moments after he was fatally stabbed has appeared in court again.
The man faced the Dandenong Magistrates’ Court on Wednesday facing charges of burglary and theft of a motor vehicle.
It is alleged the man trespassed into a building in Windsor with the intent to steal in July 2022.
A few months earlier, he was believed to have been involved in the alleged theft of an Audi at Seaford in May.
His lawyer requested to have the matter transferred to the Melbourne Magistrates’ Court but the request was denied by Magistrate Tony Burns who couldn’t establish a reason for it to be moved in the “interest of justice”.
The man was re-sentenced in November last year after breaching his corrections order in March 2022, following his involvement in a brawl that resulted in the death of Mr Smith.
The court heard the group of men had been verbally harassing Mr Smith and his girlfriend before the fight broke out.
The man was sentenced to an eight-month community corrections order after pleading guilty to affray for his role in the fight.
At the time of sentencing in August 2021, he had served eight month in pre-sentence detention which was taken into account on his sentence.
The man, who appeared via video link from prison on Wednesday, is expected to return to court on February 23 for a contest mention.
