A Melbourne tech entrepreneur charged with orchestrating a BDSM gang rape has been ordered to surrender his passport to the Indian Consulate to be renounced as plea negotiations break down.

Three men, Colin Charles, 36, Shams Rehman, 64 and Joseph Deepak, 40 will contest allegations of surprising a tied and gagged woman in BDSM scenario with non-consensual group sex, a court has heard.

Mr Charles allegedly brought Mr Deepak and Mr Rehman into the bedroom and it is alleged the three engaged in sexual acts with the woman against her will.

Mr Charles is the “self-employed” Director of YEMECompany Pty Ltd, a finance budgeting and expense tracking app.

Police allege on the night of the incident the woman was tied up completely gagged, blindfolded and had noise cancelling earbuds in her ears.

The defence argued the complainant gave “consent in general” when she “smiled” after her blindfold was removed and she saw other people in the room and Mr Charles said “welcome to your gangbang”.

The complainant said she consented to the bondage, but alleged she did not know other men would be brought in for sex and denies giving consent, the court heard.

The court heard negotiations around a possible deal where Mr Charles would plead to some charges had broken down and the matter would not resolve.

If the deal had gone ahead Mr Charles would have taken on the responsibility of the alleged offending of his co-accused who are charged with sexual offences on a complicity basis.

Mr Charles’ barrister asked that the court vary his bail so that his Indian passport, which had been confiscated as part of his bail, would be temporarily returned so he could take it to the Indian consulate and have it officially renounced.

The matter was adjourned for committal in December.
