Ex-elite private Melbourne schoolboy jailed for rape

A former Wesley College and Trinity Grammar schoolboy had just returned from a volunteer trip to Cambodia when he asked a girl he knew over to his house because he was “upset”. What then happened left her with “profound anguish and anxiety”.

A former elite private schoolboy who raped a girl he knew has been jailed for at least 18 months.

Max Maddock, 21, was last Friday sentenced in the County Court to a maximum of three years in prison after he pleaded guilty to one charge of rape.

Maddock had just returned from volunteer work in Cambodia when he invited the girl to his house on July 19, 2017 because he was “upset about stuff”.

The victim agreed and was driven to Maddock’s home by her mother.

Maddock and the girl, both aged 20 at the time, went to his bedroom.

He told her that his brother would be home later.

The former Wesley College and Trinity Grammar student then pushed his victim onto the bed, put his hand around her throat and pulled her pants down.

He then made a comment about her underwear, touched her genitalia, bit her breast and raped her.

Judge Wendy Wilmoth said the victim was distressed while Maddock penetrated her for “two to three minutes”.

“(She) cried and told you to stop and get off her but you ignored her,” Judge Wilmoth said.

Maddock told the victim to “act normally” when his brother arrived home not long after.

The girl stayed at the home playing games with Maddock and his brother until she was picked up by her mother at 10.30pm.

The victim reported the rape to police on August 29.

She was cross-examined at a contested committal hearing in April 2018.

The girl said in her victim statement that she had suffered “profound anguish and anxiety” since the assault.

The court heard she gave up her university course, had trouble holding down a stable job and suffers from flashbacks and nightmares.

“Cannot understand why (Maddock) as a friend did what (he) did,” she said.

Additionally, the victim’s mother said she felt “guilt for having driven her there that night” and was “horrified” to hear what happened to her daughter months later.

Judge Wilmoth said Maddock pulled a knife on the new partner of an ex-girlfriend prior to raping this girl.

She labelled his offence as “spontaneous and opportunistic” but “not out of the blue”.

“You had tried once before to take advantage of the complainant sexually,” she said.

“(It was a) breach of the trust she had afforded you and you exploited her kindness.

“She was obviously distressed but you continued anyway … your actions were humiliating for her.

“(The victim) lost weight, became depressed and withdrawn from her family.

“(She is) scared to go out in fear of running into you.”

Judge Wilmoth took into account Maddock’s age and he was “profoundly remorseful” but said sexual offending must be deterred.

Maddock was sentenced to three years with a minimum of 18 months.

He had spent eight days in custody at the time of sentencing.
