A man accused of murdering a Morwell woman was seen curled up on the floor with his dog in her lounge the night before she was found unresponsive, according to a neighbour who was in an on/off relationship with her, a court was told.

Scott Kennedy allegedly caused the death of 45-year-old Narelle Emerson who was found unresponsive in her Sydney Rd home on October 18, 2019 and later died from her injuries at The Alfred hospital.

He has pleaded not guilty and is being tried before a jury in the Supreme Court and the trial is expected to last three weeks.

The evidence of John Flegg, who was in an on/off relationship with Ms Emerson and who has since died, was read out in court on Wednesday.

According to Mr Flegg, himself, Ms Emerson and Mr Kennedy, who was homeless at the time, had dinner together and watched TV at her house on October 17, 2019.

Mr Kennedy was taken to her house that day by a 13-year-old female friend who called Ms Emerson “aunt”.

Narelle Emerson had been drinking vodka the day before she was found unresponsive in her bedroom, a jury has heard.

Mr Flegg said after dinner and when the teenger had left, a drunk Mr Emerson told him to “get out” and he left after having eight cans of beer over eight hours.

The court earlier heard that Ms Emerson had been drinking vodka that afternoon.

He told police he was surprised Ms Kennedy didn’t leave with the 13-year-old before dinner.

Mr Flegg said he didn’t know how she got her injuries and when he left after dinner, Mr Kennedy was curled up on the floor with his dog in the lounge.

His 000 call after discovering injuries to her head and blood on the doona was played to the jury.

The court heard Mr Flegg told the call taker he thought Ms Emerson may have suffered an epileptic fit and was not breathing normally.

He said his relationship with her was “pretty solid” but was no good when she drank vodka. “But we loved each other” he said.

Mr Flegg died of cancer in 2020.

The trial continues.
