A Keysborough logistics company and its director have pleaded guilty to conduct that resulted in the death of a delivery driver near Shepparton.
Onkar Group Pty Ltd and its director Maninder Singh Nagi, 49, fronted the Shepparton Magistrates’ Court on March 19.
In August 2022, a delivery driver was 12 hours into a shift delivering baked goods in Victoria’s north when his delivery van drifted into the path of an oncoming truck in Kialla West.
The delivery driver died at the scene at the intersection of the Goulburn Valley Highway and Moira Dr, while the truck driver sustained serious injuries.
Onkar Group and Nagi were committed to the Shepparton County Court and pleaded guilty to five charges.
Nagi pleaded guilty to failing to provide a safe working environment and failing to provide information, instructions and training to employees necessary to enable them to perform their work safely and without risk.
He also pleaded guilty to ensuring people other than employees were not exposed to risks to their health and safety as reasonably practicable.
The business pleaded guilty to recklessly engaging in conduct that placed another person at a workplace in danger of serious injury, failing to provide and maintain a safe working environment and safe systems of work, and ensuring people other than employees were not exposed to health and safety risks.
Nagi and Onkar Group will appear in the Shepparton County Court in May for a plea hearing.
The business made a request for the matter to be heard in Melbourne, however both parties were ordered to attend the Shepparton court, with advice they could apply for a transfer at a later date.
