Mooroopna tradie Braydon Miller pleads guilty at the Shepparton Magistrates’ Court

A drunk Mooroopna tradie punched a man and threw him to the ground after the man and his dog “irritated” him.
Braydon Miller pleaded guilty to one count of assault in company at the Shepparton Magistrates’ Court on Friday.
The 21-year-old had gotten drunk with his brother and dad at the Sky caravan park in Murchison on October 30, 2020.
The male victim, who lived at the park, had been walking his Jack Russell terrier past other caravans where dogs were also living.
Aggravated, drunk and tired of all the barking, the trio approached the man and assaulted him.
The court heard the 21-year-old swung a punch to the man’s chin and threw him to the ground, before taking the dog’s leash off its collar so it could escape.
Miller continued to kick and punch the man while he was down, and the trio’s own black dog bit the man on his right cheek bone.
The court heard Miller’s father received a $500 fine and his brother was placed on a community corrections order in previous court hearings.
Miller’s defence lawyer Shana McDonald said the 21-year-old was working full-time as a concreter.
She said Miller felt remorse for his drunken behaviour and for causing harm to the man.
“When I heard someone being kicked, I immediately thought of jail — my antenna came up,” Magistrate Peter Mithen told Miller.
“It doesn’t matter what the victim’s been doing.
“You don’t take matters in your own hands.”
Mr Mithen placed Miller on a good behaviour bond for a period of 12 months and ordered him to pay $200 to the court contribution fund.
“Next time you’re tempted to raise a fist to someone just think what could have happened here today,” Mr Mithen said.
