David Berry pleads not guilty to allegedly killing cyclist, to stand trial in court
A Seymour man accused of killing an Alexandra motorcyclist in an allegedly stolen car will stand trial after pleading not guilty to a string of charges.

A Seymour man will stand trial after allegedly killing an Alexandra motorcyclist in an allegedly stolen car in Yarck.
David Graham Berry, 42, appeared in the Shepparton Magistrates’ Court on Wednesday, February 5 for a committal hearing
He has been charged with culpable driving and dangerous driving causing death and failing to stop or render assistance after a collision when a person was killed.
Mr Berry was also charged with trespassing intending to steal, stealing a red Milwaukee radio, Ford Ranger Utility keys and a Ford Ranger valued at $40,000.
Magistrate Simon Zebrowski said he found “sufficient weight” in the allegations to support a conviction and committed Mr Berry to a trial at the County Court.
He said he would transfer further charges to the County Court as related summary offences.
The charges were driving without a licence, driving under the influence of a drug and alcohol, speeding more than 30km/h over the limit and failing to drive on the left side of the road.
Mr Berry has pleaded not guilty to all charges.
It is alleged Mr Berry stole a white Ford Ranger from the Euroa ‘Middle Pub’ at 2.40pm on May 9, 2024 before his allegedly erratic driving killed a 56-year-old man travelling the other way.
Mr Berry then allegedly fled the scene and was seen by locals trying to hitchhike a lift out of the area.
Following an extensive search, police found and arrested Mr Berry.
Mr Berry appeared via video link from custody and did not apply for bail.
He will appear in the Melbourne County Court on March 5 for a directions hearing.
