An Albury old age pensioner has avoided jail after being busted for a number of sex-related offences, including unlawful assault.
Frank Edward Sollitt was found guilty on a number of charges on Thursday in the Shepparton Magistrates’ Court, most notably of sexual assault.
His lawyer Simon Kelly said Sollitt suffered from a “low functioning” mental capacity and urged Magistrate Alexandra Burt to finalise the matter today.
Mr Kelly also urged Ms Burt to not allow the media to publish Sollitt’s name, believing that would be unfairly punishing him further.
Ms Burt denied Mr Kelly’s request, saying it was in the public interest to publish Sollitt’s name.
Ms Burt said that Sollitt may have an “issue of cognitive decline or impairment”.
Ms Burt sentenced Sollitt to a 18-month Community Corrections Order, under the conditions he will be supervised and “engage in programs to reduce the risk of reoffending”.
Ms Burt ordered that Sollitt have a mental health assessment as part of his community corrections order.
Ms Burt did not place Sollitt on the sex registry.
