Poor decision-making leads man to drink drive, refuse drug test, lawyer says

A 28-year-old man has narrowly escaped conviction after he was stopped by police for speeding and found to have more than twice the legal amount of alcohol in his system.

A man has avoided conviction but been disqualified from driving for two years after he was caught speeding with more than twice the legal amount of alcohol in his system.

The Heidelberg Magistrates’ Court heard on January 7 that conveyancer Keegan Duque, 28, believed he was fine to drive after a big night out on the booze when he got behind the wheel on March 10 last year.

He was nabbed by police speeding at 95km/h in an 80km/h zone on the Metropolitan Ring Rd between Plenty Rd and Greensborough Rd in Watsonia North.

He provided an evidentiary breath test of 0.103 when tested for alcohol but then refused to undergo a drug test.

Upon fronting court, Duque pleaded guilty to speeding, drink driving and refusing to provide an oral fluid sample for the purpose of a drug screening.

Magistrate Stephen Ballek cancelled his licence, disqualified him from driving for two years and slapped him with an $850 fine.

Duque escaped conviction, with his lawyer arguing he had no criminal history and a conviction would damage his future career prospects.

She also told the court Duque was “ashamed and embarrassed” by his offending and a lack of awareness about the time it took alcohol to leave his system had contributed to the offence.
