Monash University student Alan Yuen dodges jail after having sex with ‘vulnerable’ schoolgirl

A Monash Uni accounting student who volunteers helping “new students” has been exposed as a sex fiend after “sexually aggressive” messages were discovered on his 15-year-old victim’s high school-issued laptop. But that wasn’t the worst of it.

A Monash University student was exposed as a sex fiend after “sexually aggressive” messages shared between him and a Year 9 student were discovered on her school laptop.

Alan Yuen, 20, was sentenced in the County Court to a three-year community correction order after pleading guilty to the sexual penetration of a child under 16.

Yuen was 19, almost 20, when he repeatedly had sex with the 15-year-old girl between October and December last year.

The court heard the “sad and vulnerable” girl contacted Yuen on Facebook after they met through a mutual friend, and they went on to send each other crude and sexually explicit messages.

Yuen first had sex with the girl after the two arranged for him to sneak through a window in her house and find her bedroom about 2am.

They had sex in the back of his car late at night on another occasion.

The court heard the pair were not in a relationship but there was affection, mutual respect and a lot of joking evident in their messages.

The girl was questioned by DHHS protective workers after her online conversations with Yuen, which the prosecution described as “sexually aggressive”, were found on her school computer.

She did not admit to sexual interactions with Yuen and did not provide a statement to the court.

Yuen readily admitted to the crime when he was arrested on December 5 and gave police his phone to see the messages.

Yuen said the girl “didn’t seem like a child” and their interaction didn’t seem wrong because she had previously had sex.

Judge Rosemary Carlin agreed the girl seemed older in the messages, and conceded Yuen hadn’t appeared to pressure or manipulate her, but said there was nonetheless a social and economic imbalance.

“You were at very different stages of your life,” she said.

Judge Carlin said while Yuen was immature himself he knew what he was doing was wrong.

In one message the girl asked Yuen if he liked girls in school uniforms, to which he jokingly asked if she was using it as evidence at his next court hearing.

The court heard Yuen was genuinely remorseful, had no criminal history, and eight references outlining his otherwise good character were given to the court.

The court heard the Pakenham man was an aspiring accountant in his third year of an accounting and taxation degree, who had worked from a young age and volunteered for St John’s Ambulance.

The court was told Yuen volunteered at Monash University organising public events and helping younger students.

Judge Carlin said there was virtually no risk of future offending, sentencing him to a three-year corrections order with 350 hours of community work.

She exempted him from being added to the sex offenders register.
