A Glen Waverley kebab van with a cult following has claimed victory at the state tribunal against the fuel giant trying to shut it down.
Glenny Kebabs owner Asad Syed said he would reopen his van on Springvale Rd tomorrow, and was “ecstatic” after winning an injunction against Caltex at VCAT.
The popular food van was shut down on November 28 by the fuel giant, which sublets a section of its Springvale Rd service station forecourt to Glenny Kebabs.

Caltex had cited the safety of its “customers, employees and the public” as reasons for the shutdown.
“I am ecstatic. Relieved for the staff more than anything else,” Mr Syed said.
Set to again welcome customers from tomorrow morning, Glenny Kebabs must comply with strict conditions in order not to breach its contract.
One of which is that it is “strictly a takeaway restaurant”, with no tables or chairs on site and Glenny Kebabs needs to discourage people from eating on site.
It will also only be allowed two parking bays, with no other cars allowed on site.
It also needs to erect signage on site explaining the rules to customers.
“We were quite ecstatic, for a small company to go up against a big company like Caltex, we were rapt with the result,” Mr Syed said.
An Armour Legal statement said barrister Tim Sowden submitted Glenny Kebabs “was being punished for running too much of a successful business for the type of business it was”.
A hearing has been listed for February to finally determine the matter.
“However, in the interim, this is a great win and early Christmas present for Glenny, its employees and all their loyal customers,” the statement said.
While relieved at the decision, Mr Syed said to expand were rapidly afoot.
Mr Syed hopes to open a dine-in store with 50 to 60 seats in Kingsway within one to two months, while he also wants to capture the best experience from the Springvale Rd site to a new location.
“We have got a property about 5km north of here which will be outdoor dining,” he said.
It would welcome cars and motorbikes and expand its service to ice cream, coffee and other things.
Caltex will remove the fencing today before cleaners remove all the spoiled stock, with the van to be restocked and open again from tomorrow.
